According to the country's Customs in an announcement concerning the sunset review of the case on October 8th, Australia would continue the 4% anti dumping duty levied on HSS (hollow structural sections) imported from China.

The Customs determined that to the extent that the anti dumping measures concerning the goods involved the publication of a dumping duty notice that the notice is to remain unaltered and to the extent that anti dumping measures concerning the goods involved the acceptance of an undertaking that the undertaking is to remain unaltered.

The goods covered by the review are certain electric resistance welded pipes made of carbon steel, comprising circular and non circular hollow sections in galvanized and non-galvanized finishes. The goods are normally referred to as either CHS (circular hollow sections) or RHS (rectangular or square hollow sections). In market terms, the goods are collectively known as HSS (hollow structural sections) and they are commonly used in structural and mechanical applications.

Customs and Border Protection recommended that the Minister request the CEO of Customs and Border Protection to initiate a new review of the anti dumping measures applying to exports to Australia of certain HSS from China. The reason for this recommendation was to allow Customs and Border Protection to fully consider the Trade Measures Review Officer's views on injury and causation expressed in relation to the resumed investigations of HSS from China and Malaysia1. This will ensure that the recommendations arising from the new review are consistent with the outcome of the resumed investigations.

Accordingly, the CEO has commenced a new review, public notice of which was given in The Australian on October 8th 2009. The review period is January 1st 2008 to December 31st 2008 the same as that for the recently finalized review.
