James River coal unit to pay fine

According to US Justice Department, James River Coal Co unit Triad Mining Inc has agreed to pay an USD 810,000 civil penalty and to restore waterways damaged in the unpermitted excavation and filling of streams that flow into the White River.

Triad Mining had a surface mine about 70 miles north of Evansville in Knox and Sullivan counties in Indiana.

The company also has agreed to obtain the required Clean Water Act permit for stream impacts caused by its surface mining operation.

The proposed settlement still must be approved by a federal judge after a 30 day comment period.
