
AAP reported that details of the family trust battle between billionaire iron ore heiress Ms Gina Rinehart and her children will be suppressed for another three weeks.
The NSW Court of Appeal on Friday granted a continuation of the suppression orders on details of the case taken by three of Ms Rinehart children until February 3.
Chief Justice Mr Tom Bathurst, Justice Ms Ruth McColl and Justice Ms Margaret Beazley said they would publish reasons for their decision next week.
The case has been suppressed from the beginning with orders preventing the publication of information about the evidence or arguments filed, read or given in the proceedings. However, on Friday the judges ruled the proceedings of December 19 to 21 and Friday could be reported on.
On December 19, three Appeal Court judges overturned the suppression orders, concluding they would undermine rather than ensure and public confidence in the administration of justice. That decision was stayed two days later by the Court of Appeal.
Lawyers for Ms Rinehart have said they plan to apply to the High Court for special leave to appeal the decision overturning the suppression orders. A further continuation of the suppression orders will need to be sought from the High Court before they expire on February 3.
The proceedings against the iron-ore heiress have been brought by her children Mr Hope Rinehart Welker, Mr John Langley Hancock and Mr Bianca Hope Rinehart.
Ms Gina Rinehart is the only child of the late mining magnate Lang Hancock. Her fortune is thought to be about USD 10 billion. Her three children are trying to oust her as trustee of the multi-billion-dollar family trust, set up by Mr Hancock before he died of which they are beneficiaries.
Another daughter and beneficiary, Ms Ginia Hope Frances Rinehart has joined with her mother in the dispute. When the three children brought the proceedings against Ms Rinehart in the NSW Supreme Court, she tried unsuccessfully to have them stayed on the basis of the deed clause about confidential mediation and arbitration.
Ms Rinehart is appealing the Supreme Court ruling and her challenge will be heard on February 8.
