OGL Resources Limited received a copy of an Application to the Supreme Court of Queensland by 2 individuals seeking orders pursuant to the Judicial Review Act 1991 to the effect that the decision made by the Governor in Council on the advice of the Minister for Employment, Skills and Mining on 15 September 2011 to renew the Ebenezer Mining Lease be set aside.

The first direction hearing is scheduled to take place on 20 January 2012. The applicants have stated in their application that as residents of the wider area, they oppose mining because they do not want mining operations to recommence near their residences. They have also raised concern over possible noise disturbance.

Directors of OGL Resources Limited advise shareholders that the renewal of the Ebenezer Mining Lease is in compliance with all relevant government application processes and procedures.

The Ebenezer Mine was originally opened in 1988 and operated until early 2003. During its 14 years of production it has successfully produced more than 20.5Mt of high quality thermal coal for the domestic Queensland coal market and for export. The Ebenezer Mine is located close to 2 other existing operating coal mines.

Media reports also mention the Bremer View Coal Project which is not subject to any legal action. OGL Resources Limited has an option to acquire the Ebenezer Mine and the Bremer View Coal Project.

The Company is continuing to make significant progress on the projects with the key stakeholders and infrastructure providers with the belief all the licenses are in good order and will continue to fulfill its obligation under the Sales and Purchase Agreement with Zedemar Holdings Pty Ltd.
