
OJSC MMC Norilsk Nickel announces that Krasnoyarsk Krai Commercial court has voiced the operative part of its resolution on the case ?33-583/2012 concerning the claim filed by OK RUSAL Investment Management LLC to make the September 13th 2011 and September 21st 2011 resolutions of the company's board of directors void, satisfying the asserted claim.
Following the receipt of the operative resolution produced by the court of original jurisdiction and analyzing the circumstances that have led to approving judicial decree, the company shall take all the required judicial steps to appeal the court ruling, before it reaches legal validity on the grounds that all the case materials contain documented confirmation of sound reasoning and legality of accepting the contested corporate decisions.
The decision of Krasnoyarsk commercial court which has not yet become effective in law will not bear any substantial effect on the company's liabilities or any financial indicators.
Norilsk Nickel views the numerous legal claims filed by RUSAL contesting resolutions of the company's board of directors as an attempt to destabilize normal operation and questions their stated motive of protecting the legal rights and interests of shareholders.
