
Interfax reported that the Russian corporation VSMPO-Avisma and its US branch VSMPA-Tirus have won a court case involving allegations of dumping in shipments of magnesium to the United States.
Judge Ms Judith Barzilay of the United States Court of International Trade ruled that the method used by the Department of Commerce to determine the value of magnesium produced by VSMPO-Avisma was faulty, causing the Department to predetermine company revenues from operations with the metal.
According to the official court opinion the court found that Commerce has failed to take into account Avisma ordinary course of business in calculating the value for chlorine gas, its methodology does not accord with law.
The court ordered that "Commerce recalculate the value for chlorine gas in its determination of the normal value of the subject merchandise, taking into account Avisma ordinary course of business by focusing on Avisma entire production process, including the stages of production encompassing and following ilmenite catalyzation and that Commerce shall have until November 9, 2010 to file its remand results with the Court. Plaintiffs and Defendant-Intervenor shall file comments if any with the Court no later than December 7th 2010."
